The right to access information

The right to access information and reuse of information held by Sport Hub Nedelišće d.o.o. is exercised in accordance with the Act on the Right to Access Information (Official Gazette 25/13) and the Act on Amendments to the Act on the Right to Access Information (Official Gazette 85/15).
The aim of the Act is to enable and ensure the exercise of the right to access information guaranteed by the Constitution of the Republic of Croatia, as well as the reuse of information by natural and legal persons through the openness and transparency of public authority activities.
 
The right to access information is based on the principles of publicity and free access, timeliness, completeness and accuracy of information, the principle of equality, the principle of access to information and, in accordance with Article 5, paragraph 1, item 5 of the Act, it includes the right of users to request and obtain information as well as the obligation of public authorities to provide access to the requested information, or to publish information regardless of the request made when such publication also results from obligations specified by law or other regulation.
 
No administrative or court fees are payable for access to information in proceedings before public authorities.
 
Information, within the meaning of the aforementioned Act (Article 5, paragraph 1, item 3), represents "any data held by a public authority in the form of a document, record, file, register or in any other form, regardless of the manner in which it is presented (written, drawn, recorded, magnetic, optical or some other record)".
 
Reuse of information, in accordance with Article 5, paragraph 1, item 6 of the Act, "means the use of information of public authorities by natural or legal persons, for commercial or non-commercial purposes other than the original purpose within the framework of the public work for which the information was created. The exchange of information between public authorities for the purpose of performing tasks within its scope of competence does not constitute reuse".
 
The user exercises the right to access information by submitting an oral or written request to Sport Hub Nedelišće d.o.o.
 
If the request is submitted orally or by telephone, an official note will be drawn up, and if it is submitted via electronic communication, it will be deemed that a written request has been submitted.
 
The right to access information and reuse of information is exercised by submitting a request to the following address:

The applicant is not obliged to state the reasons for requesting access to the information, and in the request may also propose a way in which Sport Hub Nedelišće d.o.o. will make the information available.
 
In the event of an incomplete or incomprehensible request, the applicant will be invited to correct the request without delay within five days of receiving the invitation to correct it. If he fails to do so, the request will be rejected as incomprehensible or incomplete. Sport Hub Nedelišće d.o.o. will provide the applicant with access to the information within 15 days of the proper submission of the request. Exceptionally, the aforementioned deadline may be extended up to 30 days if the information must be requested outside the headquarters of Sport Hub Nedelišće d.o.o., if a single request requests a larger amount of information, if this is necessary to ensure the completeness and accuracy of the requested information, and if it is necessary to conduct a proportionality and public interest test, in accordance with the provisions of this Act. Sport Hub Nedelišće d.o.o. will notify the applicant of the extension of the deadlines without delay, and no later than within 8 days, and state the reasons for the extension of the deadline.

Sport Hub Nedelišće d.o.o. has the right to compensation for actual material costs incurred in providing information to the user of the right to access information and reuse information, as well as compensation for the costs of delivering the requested information.
 
The amount of the fee for access to information and reuse of information is determined in accordance with the criteria set out in Article 19, paragraph 3 of the Right to Access Information Act, and the stated criteria for determining the amount of compensation for actual material costs and costs of delivering information were published in the Official Gazette, No. 12/14.
